St. Helens R.F.C has engaged the services of Briconomics Fundraising Ltd. to execute and fulfil Wall of Legends. Briconomics Fundraising Ltd. Sunnycroft Brickworks, Tanyard Lane, Danehill, West Sussex RH17 7JH England. Company Registration Number: 3526456.
You have read and agree to be bound by our Terms and Conditions. All orders are subject to acceptance by Briconomics Fundraising Ltd. Once your payment has been authorised by the bank you will receive a confirmation of your order by email, along with your E-Certificate. Please retain this email as it contains your order reference number and your Brick/Tile ID number which you may need for future reference. Any acceptance of your order by Briconomics Fundraising Ltd. is subject to these Conditions of Sale and to the availability of stock.
Briconomics Fundraising Ltd. reserves the right to withdraw any Product(s) from Wall of Legends website shop and may, in its sole discretion, refuse to process an order for any reason at any time. Without prejudice to your statutory rights as a consumer, Briconomics Fundraising Ltd. will not be liable to you or a third party by reason of Briconomics Fundraising Ltd. withdrawing any products or refusing to process any order.
In rare instances, we may not be able to site your Product(s) in a suitable location, even though Wall of Legends has indicated there is availability. Where this is the case, we will inform you of this by email and will give you the option of selecting another product(s) or cancelling your order.
Price and Payment
All prices are quoted in £ and include VAT. Delivery charges apply for Replica and mybrickcard™ product(s) and are as laid out on the Payment Confirmation. The prices payable for the Product(s) that you order are as set out on the website at the time at which you place your order.
Payment may be made using a wide selection of credit and debit cards. You confirm that the credit/debit card which is being used is yours. Your credit/debit card details will be transmitted via the web to a secure server. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. Briconomics Fundraising Ltd. reserves the right to refuse credit card payments in its reasonable discretion.
Briconomics Fundraising Ltd. will take payments and you will receive confirmation of your payment. The transaction will show as Briconomics Fundraising Ltd on your statement
Description of Product(s)
The Products depicted in the Website Shop is as seen. The reproduction of colours and styles are as accurate as photographic and image processing will allow. Briconomics Fundraising Ltd. does not accept responsibility for slight variances in colour and style. You can amend your inscription as many times as you like until your confirm your inscription by selecting the link on the confirmation email and following in the instructions. If you don’t confirm your inscription within 10 days the system will automatically lock your order /inscription. Thereafter we cannot accept a cancellation, return or make any changes should you simply change your mind, as the product(s) will be personalised as per your order specification.
Subject to an order being accepted by Briconomics Fundraising Ltd. customers will receive an E- Certificate(s) of Authenticity attached to an email confirming their order. Customers should refer to their Certificate for their unique tile reference number which will be required in order to identify the area in which their tile will be placed. You can log back into your account at any time to check the progress of your order but you will be sent regular notification emails.
The whereabouts of the tile may not be made available until the tiles are installed.
Each engraved tile can have up to 25 characters on each line. Punctuation marks and spaces will count as 1 character.
All messages will be checked for derogatory language and phrases, and Briconomics Fundraising Ltd / St. Helens R.F.C reserve the right to withdraw product(s) should they deem that you intended to, or if placement of the Product(s) is likely to, cause insult, embarrassment or offence to an individual, group or organisation. If Briconomics Fundraising Ltd/St. Helens R.F.C receives a complaint from an individual, group or organisation in relation to the content of your Product(s) it reserves the right to remove and destroy the Product(s). In either case you shall not be entitled to any refund of monies paid to Briconomics Fundraising Ltd. and you waive your rights to make any claim for damages or any costs against Briconomics Fundraising Ltd. as a result.
All product(s) will be produced according to the product specification and your order, before being placed in a location in the Wall of Legends. You will be advised of the date that it is to be installed by email. Further information on the installation period will be available on https://www.saintswalloflegends.com/
Ownership of tiles installed within St. Helens R.F.C development will remain with Briconomics Fundraising Ltd. and transfer to St. Helens R.F.C upon delivery and as such St. Helens R.F.C shall determine the specific location of each and every tile, undertake the installation and maintenance of the product(s) thereafter.
St. Helens R.F.C retains the right to move or relocate (at any time) a product at its discretion; and may permanently remove or destroy the product on or after the tenth anniversary of its installation.
Once placed, tiles must not be altered in any way, whether this is by pen, marker, Tipp-ex, paint etc. St. Helens R.F.C. reserves the right to take appropriate action should this occur.
Briconomics Fundraising Ltd. will deliver the Replica Product(s) ordered by you to the address, which you give for when you make your order. We will email you prior to despatching your replica item(s) asking you to confirm the address we hold on record for you is still correct, you may at this point specify a delivery address which is different from your invoice address, if, for example, you would like Briconomics Fundraising Ltd. to deliver the Replica Product(s) directly to a friend, a relative, or to your place of work. It is the purchaser responsibility to advise Briconomics Fundraising Ltd. of any change of email address. We will email you to let you know that your replica has been dispatched. A signature will be required on delivery. If there is no one to sign for the item the carrier will leave a card with instructions on how to arrange re-delivery. Replicas can only be delivered within the UK.
Briconomics Fundraising Ltd. uses a range of carriers to fulfil deliveries. This enables our service to continue unaffected, for example, during industrial action. Delivery charges apply and are as laid out on the Delivery Details.
If you do not receive your Replica Product(s) within 30 days of the corresponding tile being installed at St. Helens R.F.C, you must notify us. Briconomics Fundraising Ltd shall have no liability to you unless you notify them by email at email@example.com of the problem or for any indirect or consequential loss caused by late delivery or failure to deliver. Unless you have cancelled your order prior to delivery, you will become the owner of the Replica Product(s) once they have been delivered to you or the designated collection point. In any case, after delivery they will be held at your own risk and Briconomics Fundraising Ltd. will not be liable for any loss, damage or destruction to the Replica Product(s) except insofar as it arises from an inherent defect in any of the Replica Product(s)s
If the Replica product(s) you have ordered arrives damaged, advise us by email at firstname.lastname@example.org within 7 days of delivery; we will then ask you for photographic evidence of the damage and of the packaging so we can revert to the relevant delivery provider. Due to the nature of the product(s), replacements will take longer and will be produced by Briconomics Fundraising Ltd. within 60 working days of receipt of the your email advising us of the defect.
Lost in Transit
We cannot be held responsible for packages lost in transit; If a consignment is not received you must allow us 30 days to investigate this with the delivery provider, if, after that time we have not been able to locate your original item we will of course provide a replacement. Due to the nature of the Product(s), replacements will take longer and will be produced by Briconomics Ltd. within 60 working days.
Taxes and Duty
Any customs or import duties are levied once the package reaches its destination country. Additional charges for customs clearance must be borne by the recipient. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you may want to contact your local customs office for further information before ordering.
Unless otherwise agreed in writing, Briconomics Fundraising Ltd.'s maximum liability to you arising by reason of or in connection with the supply of the Product(s) to you shall be limited to the amount paid by you in respect of the Product(s) in question.
Briconomics Fundraising Ltd. shall not in any event be liable to you for:
- Any direct loss; Or
- Any loss of profits, business or anticipated savings or loss of or corruption of data or any indirect loss or consequential loss what so ever even if it has been advised of the possibility of such loss. This does not affect your statutory rights as a consumer.
Nothing in these conditions of sale shall exclude or limit the liability of Briconomics Fundraising Ltd. for death or personal injury due to its negligence or for its fraud. This does not affect your statutory rights as a consumer.
Events beyond our control
We shall have no liability to you for any failure to perform services ordered by you or to deliver replica tiles you have ordered or any delay in doing so or for any damage to or defect in goods delivered caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems, flood, fire, explosion or accident.
Briconomics Fundraising Ltd. shall have no liability to you for any delay or failure to deliver the Product(s) to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of Briconomics Fundraising Ltd. including, but not limited to, fire, floods, acts of God, acts or regulations of any governmental or supranational authority, war, riot, strike, lock-out and industrial disputes.
No waiver by us shall be construed as a waiver of any rights or remedies, or any subsequent breach of any provision of these Conditions of Sale.
These Terms and Conditions shall be exclusively governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
